Fighting Speeding Tickets in Macomb County – Clinton Township, Warren, Mt. Clemens, Sterling Heights Lawyer

We understand that almost everyone exceeds the speed limit from time to time. Whether we are late for work – or just absent-mindedly “keeping up with traffic” – it is very easy to drive faster than posted speeds. Add to that “speed traps” – where speed limits suddenly drop and/or police are hidden from view using radar – and your chances of getting a speeding ticket increase even more.

When you are issued a traffic ticket for speeding, you are understandably worried about how much it will cost you in fines, how many points you may get, and what it will do to your insurance rates. And, Michigan traffic ticket fines and penalties can be very confusing. Justin Vande Vrede is an experienced speeding ticket lawyer who can help you understand the penalties you may be facing <em>and</em> the best steps to take to get the best possible results.

Speeding Ticket Fines & Penalties in Macomb County – Clinton Township, Warren, Mt. Clemens, Sterling Heights Lawyer

The fine associated with your Michigan traffic ticket depend up on the city (district) where you received your traffic ticket. For example, a speeding ticket received in Warren may cost more than a speeding ticket received in Mt. Clemens. In most cases, the fee will be listed in the “fine print” on the ticket you received. If you have lost or misplaced your speeding ticket you can call the district court both to check on the possible fine, and to find out when and where you need to appear in Court.

Remember you never want to miss your speeding ticket court deadline, as this will result in additional fines and penalties – and may even result in a suspended license or a warrant for your arrest!

Fees for Macomb County Speeding Tickets:  Clinton Township, Warren, Mt. Clemens, Sterling Heights Lawyer

Fines for speeding will vary from district to district, but here is a standard list of “ball park” fines you might face if you’re pulled over for speeding in Macomb County:

  • Speeding 1-5 MPH over the speed limit: $90
  • Speeding 26+ MPH: over the speed limit: $155 + $4 per additional mile

On top of the fine for the actual moving violation, speeding tickets can also have additional fees added to them, called “surcharges”. Further, if your license ends up being suspended, you will also incur very large “driver responsibility fees.”

Points for Macomb County Speeding Tickets – Clinton Township, Warren, Mt. Clemens, Sterling Heights Lawyer

There are points for every traffic violation that is given for speeding, and they go up in value as the severity of the speeding ticket increases.

Points in Michigan are set by the Michigan Vehicle Code and are the same across all cities (or “jurisdictions” or “districts”). Points placed on your driving record remain there for two years from the date of conviction. Points will not only result in an increase in your insurance rates, but can also result in your license being suspended.

Points for Speeding in Michigan as set by the Michigan Vehicle Code are:

  • 10 mph or less over the legal speed limit = two points
  • 11 through 15 mph over the legal speed limit = three points
  • 16 mph or more over the legal speed limit = four points
  • Reckless driving = 6 points
  • Fleeing or eluding a police officer = 6 points

If you accumulate too many points the Michigan Secretary of State may restrict, suspended, or even revoke your driver’s license.

If your license is suspended, you will be given a start and end date to your suspension – after which you can go into a Secretary of State branch, pay your reinstatement fee, and reinstate your license. However, if your license is revoked, you will have to <em>reapply</em>for your license before the DAAD after waiting at least 1 year. If your license is revoked a subsequent time, you will have to wait five years before applying to the DAAD for reinstatement.

Points remain on your driving record for two years from the date of the conviction or guilty plea. However, points from certain Michigan moving violations can be removed from your record by completing a basic driver improvement course (BDIC). Remember, though, Michigan drivers are allowed to take a BDIC course to remove points only one time in their lifetime.

Car Insurance Rates & Macomb County Speeding Tickets – Clinton Twp, Warren, Mt. Clemens, Sterling Heights Lawyer

Perhaps the biggest cost of getting one or more speeding tickets is the insurance premium increase that you will face. If you accumulate multiple speeding tickets, the associated points add up on your driving record and your Michigan auto insurance rates will go up substantially. In extreme cases, your insurance company might even drop your insurance coverage entirely. Since it is illegal to drive without insurance in Michigan, you want to make sure that you do not accumulate so many points that insurance is either unaffordable or dropped entirely.

Some people who get speeding tickets try to “save money” by representing themselves – and not hiring a lawyer.  But what they do not understand is that hiring an affordable speeding ticket lawyer to reduce (or even eliminate) points for speeding will cost them a lot less than the insurance rate hikes that they will probably get if they represent themselves.
